Expert Witness Reports for Builders and Contractors in NSW

Builders and contractors are often placed under significant pressure when a homeowner alleges defective work, incomplete work, poor workmanship, overcharging, non-compliance or failure to rectify. In many cases, the builder may strongly disagree with the allegation, but still needs independent expert evidence to properly respond.

Awesim Building Consultants prepares independent Expert Witness Reports, defect assessments and Scott Schedule responses for builders and contractors involved in residential building disputes across Sydney, regional New South Wales and NCAT proceedings.

Led by Glen Sim, Awesim brings more than 35 years of building and construction experience to the inspection and reporting process. This practical experience allows Awesim to understand the realities of construction work, trade sequencing, site conditions, variations, progress claims, incomplete works, workmanship disputes and rectification issues.

For builders, an expert report can be critical. It can help determine whether the alleged defects are genuine, whether the claimed rectification scope is reasonable, whether the work complies with the National Construction Code, Australian Standards and accepted building practice, and whether the homeowner’s claim is technically supported.

Awesim’s role is not to advocate for the builder. The role of an expert witness is to provide an independent opinion based on evidence, inspection, experience and relevant construction requirements. This independence gives the report credibility in NCAT, court proceedings, mediation and settlement negotiations.

Helping Builders Respond to Defect Claims

A homeowner may prepare a list of alleged defects that includes genuine issues, minor maintenance items, incomplete works, cosmetic concerns, contractual disputes and sometimes items that are not defects at all. Without proper technical assessment, these issues can quickly become inflated, misunderstood or incorrectly presented.

Awesim assists builders by inspecting the alleged defects and providing a clear expert opinion on whether each item appears to be defective, incomplete, non-compliant, unsupported or outside the builder’s responsibility.

A builder may require an Expert Witness Report where there are allegations involving:

  • Defective residential building work
  • Incomplete work claims
  • Poor workmanship allegations
  • Waterproofing and leaking bathroom disputes
  • Balcony and external water ingress claims
  • Roofing, guttering and drainage defects
  • Cracked tiles, walls, ceilings, slabs or render
  • Defective windows, doors and thresholds
  • Painting, plastering, flooring or finishing disputes
  • Progress payment disputes
  • Variation disputes
  • Termination or abandoned works
  • Rectification cost disputes
  • Scott Schedule responses
  • NCAT home building proceedings
  • Claims under the Home Building Act

In many matters, the builder does not need a general inspection report. The builder needs a structured expert report that responds to the actual allegations in dispute.

Independent Expert Evidence for Builders

An expert witness report prepared for a builder must still be independent. This is important.

The expert is not engaged to simply defend the builder or reject every item raised by the homeowner. The expert’s duty is to provide an objective opinion. If the work is defective, the report should say so. If the allegation is not supported, exaggerated, incorrectly described or unrelated to the builder’s work, the report should explain why.

This balanced approach is often more powerful than a one-sided response. NCAT Members, lawyers and other experts are more likely to place weight on a report that acknowledges genuine issues while carefully explaining why other allegations are not technically supported.

For builders, this can assist in narrowing the dispute. It may help identify which items require rectification, which items can be reasonably disputed and which items may require further evidence, testing or documentation.

Scott Schedule Responses for Builders

Many NSW building disputes require the parties to prepare or respond to a Scott Schedule. A Scott Schedule is commonly used in NCAT building disputes to identify each alleged defect or incomplete work item, the claimant’s position, the respondent’s position, the expert opinion, the rectification scope and the claimed cost.

For builders, a Scott Schedule can be one of the most important documents in the dispute. If the builder’s response is too brief, unclear or unsupported, the homeowner’s claim may appear stronger than it actually is.

Awesim assists builders and contractors by preparing expert input for Scott Schedule responses. This may include:

  • Reviewing each alleged defect item
  • Inspecting the relevant building work
  • Identifying whether the item is defective or incomplete
  • Commenting on compliance with applicable standards
  • Responding to the homeowner’s expert opinion
  • Assessing whether the claimed rectification method is reasonable
  • Commenting on whether the claimed rectification cost appears excessive
  • Providing alternative rectification recommendations where appropriate
  • Separating genuine defects from unsupported allegations

A well-prepared Scott Schedule response can help a builder present their position clearly and reduce confusion in the dispute process.

Responding to Homeowner Expert Reports

Builders are often served with an expert report prepared on behalf of a homeowner. Some reports are well-prepared and balanced. Others may include assumptions, unsupported conclusions, incorrect standards, excessive rectification scopes or items that do not properly distinguish between defective work, incomplete work, maintenance and contractual disagreement.

Awesim can assist builders by reviewing a homeowner’s expert report and preparing an independent response.

This may involve considering:

  • Whether the expert inspected the relevant areas
  • Whether the defect has been properly identified
  • Whether the correct standard or code has been applied
  • Whether the alleged cause is supported by evidence
  • Whether the recommended rectification method is reasonable
  • Whether the claimed scope of rectification is excessive
  • Whether the alleged defect may be caused by others
  • Whether the item is a maintenance issue rather than a building defect
  • Whether the alleged defect is within the builder’s contractual scope

This type of review is particularly important where the homeowner’s claim is large, the rectification scope is disputed, or the builder believes the allegations have been overstated.

Defective Work, Incomplete Work and Contractual Scope

A common issue in building disputes is the difference between defective work and incomplete work.

Defective work generally refers to work that has been carried out but does not meet the required standard, specification, code requirement or accepted level of workmanship. Incomplete work refers to work that has not been completed, or work that remains outstanding under the contract.

This distinction matters for builders because a homeowner may incorrectly describe unfinished contractual items as defects, or may claim rectification costs for work that was never part of the builder’s scope. Similarly, a builder may say an item is incomplete when it is actually defective work that requires rectification.

Awesim assists by assessing the nature of each item and explaining whether it appears to be defective, incomplete, outside the agreed scope, a variation item, maintenance-related, or requiring further evidence.

This can be especially useful after contract termination, site abandonment, payment disputes or disagreement about whether the builder was given a reasonable opportunity to rectify.

Practical Building Experience Matters

Builders need an expert who understands how construction sites actually operate. Building disputes often involve sequencing, access, weather, trade damage, variations, design changes, owner-supplied materials, incomplete documentation and workmanship tolerances.

Glen Sim’s 35+ years of building and construction experience allows Awesim to assess disputes with practical site knowledge. This is important when considering whether a defect was caused by poor workmanship, design documentation, movement, owner decisions, third-party trades, maintenance, product failure or normal construction tolerance.

A technically correct expert report must do more than list defects. It should consider causation, responsibility, compliance, practicality and reasonable rectification.

For example, a cracked tile may not automatically prove defective workmanship. It may relate to substrate movement, impact damage, inadequate movement joints, incorrect installation, poor adhesive coverage, structural movement or another cause. A water leak may not necessarily be caused by the builder’s waterproofing work. It may relate to plumbing, external drainage, maintenance, roof flashings, penetrations or later alterations.

Awesim’s role is to investigate the evidence and provide a reasoned opinion.

Waterproofing, Roofing and Building Envelope Disputes

Waterproofing and water ingress claims are among the most common and costly building disputes. Builders may face allegations involving leaking showers, failed bathrooms, balcony leaks, roof leaks, window leaks, ponding water, inadequate falls or defective drainage.

Awesim has specialist experience in forensic waterproofing investigation and building defect assessment. Glen Sim is qualified by the Master Builders Association in Waterproofing Compliance & Inspection and has extensive practical experience in waterproofing membrane application, building defects and rectification.

This is particularly valuable for builders where the alleged defect involves hidden work. A finished bathroom, balcony or tiled area may conceal waterproofing membranes, screeds, substrates, drainage details and penetrations. A proper expert assessment needs to consider how the system was built, where water may be tracking, whether the allegation is technically supported and whether the proposed rectification is reasonable.

Expert Reports for NCAT, Mediation and Settlement

Not every building dispute proceeds to a final hearing. In many cases, a properly prepared expert report helps the parties understand the real issues and move toward settlement.

Awesim’s reports can assist builders with:

  • NCAT building disputes
  • NSW Fair Trading matters
  • Mediation
  • Settlement negotiations
  • Expert conclaves
  • Scott Schedule responses
  • Solicitor advice
  • Rectification planning
  • Response to homeowner expert reports
  • Assessment of claimed defects and costs

A clear report can help a builder make informed decisions. It can identify where rectification may be appropriate, where the claim may be excessive, and where the builder may need further evidence or legal advice.
