If I could give more than 5 stars I would. I called Glen today as I was concerned with how the builder was rectifying an issue with how our showers were installed. We had established this week that our builder from 3 years ago who renovated our bathrooms had not followed code amd installed the incorrect flange while also not cutting and gluing the pipes. Our pipe from the shower fell out which uncovered the issue. I had a challenge with the builder accepting the issue but eventually he sent his plumber on site who agreed it was all done incorrectly and the builder agreed to rectify it. We asked the builder to outline how they were going to rectify and ensure the waterproofing and run off was being done to code. The explanation wasn’t satisfactory and they went ahead with a localised solution, see picture attached. Not being an expert but I could clearly see the rectification process was not appropriate to resolve the issue and have appropriate waterproofing to code so I sought out some expert independent advice and that’s when I called Glen. Sent him the details and all the pictures on the issues and he said he would set out an email for me to send to the builder. But Glen went one step further and called our builder and explained what they were doing was not correct, the possible implications of that and explained to them what they should be doing. Glen got the builder to agree and has subsequently sent a scope of work to the builder on what exactly needs to be done in a step by step method. What an absolute legend Glen is and he wouldn’t accept any payment for doing this. If you are in a similar scenario, then I couldn’t recommend Glen enough.

The Building Dispute Pathway: Where Building Commission NSW and Awesim Building Consultants Fit In

The formal process should be used in the correct order. Building Commission NSW is generally the first official point of call once direct discussions have not resolved the issue. Awesim provides independent technical evidence where the matter proceeds or rectification is not completed.

What the Building Commission process can do

Building Commission NSW may assist the parties to resolve a complaint. In some circumstances, an inspector may assess the specific alleged defective or incomplete work and may issue a Rectification Order.

It does not replace legal advice, and it is not a general inspection of every aspect of the building. Time limits can be critical, particularly where statutory warranty periods are close to expiry.

When independent building evidence is needed

If the contractor does not complete the required works, the rectification scope is disputed or the matter proceeds to NCAT, Awesim can provide independent building-consultant evidence. Building Commission NSW and NCAT: common questions

Usually, yes. Keep communication constructive, raise the concerns clearly and confirm any agreed action in writing. If the matter cannot be resolved, use the official Building Commission NSW pathway.

For matters referred for inspection, the inspector generally considers the specific alleged defective or incomplete work identified in the complaint and meets the relevant parties on site. A Rectification Order may be issued where appropriate.

Document what has and has not been completed. Depending on the matter, the next step may include NCAT. Independent technical evidence can help define the outstanding defects, standards, rectification scope and cost.
