Expert Witness Reports, NCAT & Courts
25 questionsHow long does it take to receive the report?
On most occasions, an Expert Witness Report takes around 2–4 weeks from the date of the site investigation to prepare and submit. However, complex matters may take several months to compile sufficient supporting evidence.
Why choose Awesim Pty Ltd for your Expert Witness Report?
With more than 35 years in the building and construction industry and Awesim established in 1996, we bring extensive experience and credibility. Our Director, Glen Sim, personally manages most reporting requirements. He’s a qualified builder and accredited consultant with a trade background in Carpentry/Joinery and a Diploma in Construction Management. We are fully insured with Professional Indemnity cover and recognised by NCAT and the courts for compliance with the Expert Witness Code of Conduct.
What is included in the “Bundle of Documents”?
The Bundle of Documents is the complete evidence pack submitted to NCAT or the Court. It includes:
- The Expert Witness Report and Scott Schedule
- Building Contract and Plans
- Affidavit and Statement of Claim
- Chronology of Events
- Supporting evidence and correspondence
These documents must be tabulated, paginated, indexed, and provided in triplicate – one copy each for the Court/NCAT, the opposing party, and yourself. A well-prepared bundle significantly strengthens your case by helping the Judge or NCAT Member clearly understand the dispute.
What qualifications do your Expert Witnesses hold?
Our Expert Witnesses come from trade and management backgrounds in the Building & Construction industry. The company director, Glen Sim, is a qualified Carpenter/Joiner with a Diploma in Construction Management, a NSW Builder’s Licence, and accreditation as a Building Consultant.
Are your Expert Witness Reports accepted by NCAT and the Courts?
Yes. All of our Expert Witness Reports strictly adhere to the Code of Conduct for Expert Witnesses and are fully recognised by NCAT and the NSW Court system. We frequently appear in both settings to provide evidence and clarification on our findings.
What happens after the Expert Witness Report is completed?
After your report is submitted, we can assist in conferencing with the opposing expert (Expert Conclave), attending Court or NCAT hearings, and providing clarifications or supplementary reports if required. We’re also experienced in helping clients prepare their Bundle of Documents for submission.
What type of evidence do you need before starting a report?
Typically, we’ll ask for copies of your building contract, plans, correspondence, defect lists, and any photographic or inspection evidence you already have. This helps us assess the matter in detail and ensure that our site visit and reporting are comprehensive.
Can I use your report for insurance or warranty claims?
Yes. Many clients use our Expert Witness Reports for Home Building Compensation Fund (HBCF) claims, insurance disputes, or warranty issues. Our reports are designed to be compliant and admissible for these types of proceedings.
Does Glen Sim prepare Expert Witness Reports?
Yes. Glen Sim regularly prepares independent Expert Witness Reports for homeowners, solicitors, builders, strata managers and property owners involved in construction disputes. His reports are used in NCAT proceedings, mediation matters, insurance-related claims and other dispute resolution processes involving building defects and construction issues.
Can Glen Sim assist with NCAT building disputes?
Yes. Glen Sim regularly assists clients involved in NCAT building disputes throughout New South Wales. His services include Expert Witness Reports, Scott Schedules, Building Defect Reports, construction inspections and independent technical advice. His experience helps clients better understand the technical aspects of their dispute and the rectification works that may be required.
What is an Expert Witness Report?
An Expert Witness Report is an independent technical report prepared by a qualified expert to assist parties involved in building disputes, legal proceedings, NCAT matters or mediation. Glen Sim prepares reports that assess building defects, compliance issues and rectification requirements.
When should I engage an Expert Witness?
It is generally advisable to engage an Expert Witness when a building dispute arises, significant defects are identified, legal proceedings are contemplated, or independent technical evidence is required.
Why choose Glen Sim as an Expert Witness?
Glen Sim combines more than 35 years of practical building experience with extensive expertise in construction defects, dispute resolution and Expert Witness reporting. His reports are independent, evidence-based and written in clear language.
Is Glen Sim an independent Expert Witness?
Yes. Glen Sim acts as an independent Expert Witness and understands that his primary duty is to provide unbiased expert opinion evidence based on his professional knowledge, experience and observations. When preparing Expert Witness Reports, Glen assesses the facts of each matter objectively and provides independent opinions regarding building defects, construction standards, compliance issues and rectification requirements. His reports are prepared to assist homeowners, solicitors, builders, strata managers and decision-makers in understanding the technical aspects of building disputes and construction-related matters.
Are your reports accepted by NCAT and the courts?
Yes. All of our Expert Witness Reports strictly adhere to the Code of Conduct for Expert Witnesses and are fully recognised by NCAT and the NSW Court system. We frequently appear in both settings to provide evidence and clarification on our findings.
Are your reports suitable for NCAT or court?
When engaged for expert evidence, reports are prepared with the relevant expert witness obligations and the agreed tribunal or court requirements in mind.
How long does reporting usually take?
The usual target is approximately two to four weeks after the site investigation, subject to complexity, access and receipt of the necessary documents.
Can Awesim work with my solicitor?
Yes. Awesim regularly receives instructions from solicitors and can help define the technical scope, review the available evidence and prepare reports for the relevant proceedings.
Is a Quantum Meruit Report the same as an Expert Witness Report?
Not always. A Quantum Meruit Report focuses on the reasonable value of work performed. An Expert Witness Report may address broader issues such as defective work, incomplete work, causation, compliance, standards, rectification costs and expert opinion for legal proceedings. In some matters, a Quantum Meruit Report may be prepared as part of, or alongside, an Expert Witness Report.
Can a Quantum Meruit Report be used in NCAT?
Yes, a Quantum Meruit Report may assist in NCAT building disputes where the value of work, variations, defects or incomplete construction is in dispute. The report should be clearly written, evidence-based and relevant to the issues in dispute.
Who can request a Quantum Meruit Report?
A Quantum Meruit Report may be requested by homeowners, builders, contractors, subcontractors, solicitors, insurers or parties involved in construction disputes.
Will the report recommend next steps?
Reports generally provide practical recommendations. Where specialist design, invasive testing or trade pricing is needed, we state that clearly.
Can a solicitor brief Awesim directly?
Yes. A solicitor may provide the expert brief, pleadings, relevant documents and the questions requiring opinion.
Are reports prepared for NCAT and NSW courts?
Awesim prepares independent reports for building disputes, subject to the agreed scope and the expert's applicable duties.
How quickly can a report be completed?
Timing depends on availability, site access, document volume and the complexity of the issues. Any known procedural deadline should be disclosed before engagement.
Scott Schedules & Expert Conclaves
18 questionsWhat is a Scott Schedule and why is it needed?
A Scott Schedule is a structured report outlining the specific issues in dispute — for example, defects, costs of rectification, or variations. It’s often required by NCAT or the Court to help clearly compare both parties’ expert opinions side by side.
What is a Scott Schedule?
A Scott Schedule is a structured table that itemises each defect, incomplete work item or other technical issue in dispute. It places the parties’ positions, supporting expert opinions, proposed rectification work and cost information side by side so the issues can be understood and compared efficiently.
When is a Scott Schedule required in NSW?
A Scott Schedule may be required when NCAT or a court directs the parties to organise multiple building or technical issues in a consistent format. The precise requirements and filing timetable depend on the orders or directions made in your matter, so provide those documents to your solicitor and expert as early as possible.
Does a Scott Schedule replace an expert witness report?
Usually no. A Scott Schedule is best understood as a structured companion to the supporting expert reports, photographs, documents and cost evidence. It summarises the issues; the expert report explains the observations, technical reasoning, applicable requirements and basis of the opinion in greater detail.
Can Awesim prepare a Scott Schedule for an applicant or homeowner?
Yes. We assist applicants and homeowners by clearly itemising alleged defects or incomplete work, connecting each issue to the supporting evidence, identifying a rectification approach and organising the claimed cost information.
Can Awesim respond to a Scott Schedule for a builder or respondent?
Yes. A respondent’s schedule should address every item rather than providing a general denial. We can assess whether an item is agreed or disputed, explain the technical basis for the position and provide an alternative rectification scope or cost opinion where appropriate.
Do you inspect the property before preparing the schedule?
A site inspection is commonly required where Awesim is providing technical opinions about the condition, cause, compliance or rectification of building work. The appropriate scope depends on the evidence already available and the instructions for the matter.
Can Scott Schedules be used during an expert conclave?
Yes. NCAT explains that experts may analyse their reports, identify areas of agreement and disagreement, and, where possible, draft and sign a joint Scott Schedule during the conclave process. A clear working schedule helps focus that discussion.
Does Glen Sim prepare Scott Schedules?
Yes. Glen Sim is highly experienced in the preparation of Scott Schedules for building disputes. A Scott Schedule is a structured document used to identify disputed building defects, rectification works and the positions of the parties involved. Glen assists homeowners, builders and solicitors by preparing clear and detailed Scott Schedules that help streamline dispute resolution and tribunal proceedings.
Is the correct term Scott Schedule or Scots Schedule?
What is a Scott Schedule in simple terms?
What is a Scott Schedule used for in NCAT?
Is a Scott Schedule the same as an expert witness report?
Who can prepare a Scott Schedule?
Does every NCAT building dispute require a Scott Schedule?
What happens during an expert conclave?
Can you prepare both an Expert Witness Report and a Scott Schedule?
Yes, where both are required and included in the agreed scope. The Expert Witness Report explains the technical opinions, while the Scott Schedule organises disputed items in a structured format.
Do you prepare Scott Schedules for large defect lists?
Yes. A Scott Schedule can organise numerous disputed items, the parties’ positions, technical opinions, proposed rectification and costs where these matters fall within the agreed scope.

Document and report review, as well as travel expenses, may also apply. All rates include GST and are indicative only.
What is the minimum cost of a small claim?
For a small claim involving one hour of site investigation, one Expert Witness Report, and one Scott Schedule, the minimum cost is approximately $2,750.00 (inclusive of GST).
What is the typical price range for an Expert Witness Report?
Most Expert Witness Reports fall within the $5,000 – $15,000 range, depending on the scale and complexity of the matter. For larger claims (such as multi-unit or strata complex disputes), total reporting costs can exceed $600,000 in major cases worth $10 million or more.
Do you require payment upfront?
Yes. It is company policy that all payments are made prior to both the Site Investigation and the commencement of the Expert Witness Report. This ensures the independence and objectivity of our opinions, keeping them neutral and unaffected by payment delays or disputes.
Can you provide an obligation-free quotation before starting?
Yes. We offer an obligation-free quotation for your building dispute or Expert Witness Report. This helps you understand the likely scope, timeline, and costs involved before proceeding.
Do you charge for travel outside Sydney?
Yes, travel expenses may apply for site inspections outside Sydney or the metropolitan area. However, our team regularly travels across NSW, and we always provide an upfront estimate of any travel-related costs in your quotation.
How much does an Expert Witness Report cost for an NCAT building dispute in NSW?
An NCAT Expert Witness Report in NSW typically costs between $5,000 and $15,000, with a small single-issue claim starting at a minimum of about $2,750 (incl. GST).
Awesim Building Consultants publishes fixed, itemised rates: site investigation is $1,100 for the first hour then $550/hour,
Expert Witness reporting is $1,100 per issue,
and a Scott Schedule is $550 per issue.
Conclave or NCAT/court hearing attendance is $3,850 per day.
Large strata or multi-unit matters can exceed $600,000 on claims worth $10 million or more.
All rates include GST and are confirmed in an obligation-free written quote before any work begins, so there are no surprises. Reports are usually delivered within 2–4 weeks of the site inspection.
How much does a forensic waterproofing investigation cost for an NCAT dispute in NSW?
A forensic waterproofing investigation is priced the same way as Awesim's other expert witness work:
site investigation is $1,100 for the first hour and $550 per hour thereafter, with additional reporting cost therafter.
Waterproofing matters often involve more diagnostic time than a standard defect inspection, because forensic testing — thermal imaging, moisture meters, dye testing, level checks for falls — is used to trace water pathways rather than relying on a single visual inspection. Glen Sim holds a Master Builders Association qualification in Waterproofing Compliance & Inspection, and assesses each defect against the relevant standard — AS 3740 for internal wet areas or AS 4654.2 for external balconies and decks — depending on the date and approval pathway of the original work.
All rates are GST-inclusive and confirmed in an upfront written quote before any site work begins.
How much does a Scott Schedule cost?
Fees depend on the number and complexity of disputed items, the quality of the existing documentation, whether an inspection or expert report is required, and the level of cost analysis. Awesim provides a written fee proposal once the scope and directions have been reviewed.
Can a Scott Schedule include rectification costs?
How do I request a fee proposal?
How do I obtain a fee proposal?
Send the property location, parties involved, present stage of the dispute, any deadline and a concise list of issues. Awesim will review the information and issue a written proposal.
Does a Quantum Meruit Report decide the legal entitlement to payment?
No. A building consultant can provide technical opinion about the work performed, reasonable construction value, defects, incomplete work and supporting evidence. Legal entitlement is ultimately a matter for legal advice, negotiation, tribunal determination or court decision.
Are travel costs disclosed beforehand?
Yes. Applicable regional travel requirements are identified in the written quotation before the engagement proceeds.

Building Defects, Waterproofing & Inspections
12 questionsHow do I get started with booking a Site Investigation?
You can contact us via phone, email, or the online form for an obligation-free quote. Once you accept the quote and payment is confirmed, we’ll schedule a site investigation (typically between 7:00am and 7:00pm on weekdays). From there, we’ll guide you through the process step by step.
Do I need an Expert Witness Report for NCAT, or is a building inspection enough?
Awesim Building Consultants prepares these reports — with an accompanying Scott Schedule where multiple defects are involved — for homeowners, builders and solicitors across NSW.
Director Glen Sim holds a NSW Builder's Licence and a Diploma in Construction Management, and the firm is fully insured and recognised by NCAT and the NSW courts.
My bathroom or balcony is leaking — how do I know if it's actually a waterproofing defect?
Awesim Building Consultants uses thermal imaging cameras, pin and pinless moisture meters, digital levels (to check floor falls), and controlled dye testing to trace the actual water pathway rather than assuming the nearest visible symptom is the cause.
This distinction matters in NCAT proceedings: an allegation that isn't supported by testing and moisture readings is weaker evidence than one backed by measurements tied to a specific compliance standard. Awesim's reports state plainly where a defect is supported by evidence — and equally state where it is not.
What building defects does Glen Sim investigate?
Glen Sim investigates a wide range of residential and commercial building defects, including waterproofing failures, leaking showers, roof leaks, structural cracking, defective tiling, inadequate drainage, masonry defects, plasterboard defects, painting defects, incomplete building works, non-compliant construction, balcony waterproofing failures, movement-related cracking, and defects associated with the National Construction Code and Australian Standards. His investigations provide clients with independent and evidence-based assessments of construction defects and building performance issues.
Why is Glen Sim considered a Building Defect Expert?
Glen Sim has more than 35 years of practical construction experience and has investigated a wide range of building defects including waterproofing failures, structural cracking, roof leaks, defective tiling, masonry defects, incomplete works and non-compliant construction. His combination of trade qualifications, builder licensing and building consultancy experience enables him to provide independent expert assessments of construction defects throughout New South Wales.
Can Glen Sim investigate waterproofing defects?
Yes. Waterproofing failures are among the most common defects investigated by Glen Sim, including leaking showers, balconies, bathrooms, laundries and wet areas.
Can you report on strata and high-rise building defects?
Yes. Awesim assists owners, owners corporations, builders and legal representatives with defect and dispute matters involving apartments, common property and mixed-use buildings.
What makes an Expert Witness Report different from a normal inspection?
An Expert Witness Report is prepared for a legal or tribunal purpose and must clearly explain the evidence, assumptions, reasoning and opinions. A general inspection report does not necessarily meet those requirements.
Can you investigate defects affecting strata common property?
Yes. The engagement can cover agreed defects affecting façades, roofs, balconies, podiums, common areas or individual lots. Legal responsibility is distinct from technical causation and should be addressed with the relevant advisers.
Will the report include repair recommendations?
Reports typically set out practical next steps. Where specialist design, invasive testing or trade pricing is needed, we explain that clearly rather than overstate what a visual inspection can establish.
What defects can you investigate?
Depending on scope, we investigate cracking, water ingress, waterproofing, movement, deterioration, incomplete work and other building-performance concerns.
Can photographs replace a site inspection?
Photographs can assist with initial scoping but may not establish cause, extent or surrounding construction. Awesim will advise whether on-site attendance is required.
