With all our Expert Witness Reports, Quantum Meruit Reports, Court & Tribunal hearings and other litigation support, we as an Expert Witness must abide by the Expert Witness Code of Conduct.
In New South Wales, Expert Witness’s have two documents that they must abide by, they are;
Uniform Civil Procedure Rules 2005 – Schedule 7 – Expert Witness Code of Conduct
The Expert Witness Code of Conduct explicitly states that the overriding duty of the Expert Witness is to assist the court impartially on matters relevant to the Expert Witness’s area of expertise. The Expert Witness paramount duty is to the court and not the party that retaining or makes payment to the Expert Witness.
The Expert Witness must NOT advocate for one party of the other
